Terms and Conditions for Graceful Women

These Terms and Conditions are to be read in combination with our Privacy Policy. Please ensure you understand these Terms and keep a copy for your own records. We may amend these Terms from time to time so please recheck these each time you book a Service with us.
Health and Safety
By using our Services you acknowledge and agree to the following:
“I understand that yoga includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, adjust the posture, stop if necessary and ask for support from the Teacher. I will continue to breathe smoothly.
Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. I affirm that I alone am responsible to decide whether to practice yoga. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Samantha Lindsay-German, Megan Cossar or Graceful Women.”
Our Services
Our Services are intended for domestic and private use only. You agree not to use the Services for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
If our Services are interrupted for circumstances outside of our control, we will not be liable for failure to provide Services or required to provide additional Services.
Cancellations and Refunds
Cancellations for Private Consultations are required 48 hours in advance. Within this timeframe, fees are non refundable and we are not liable to reschedule. If you cancel twice, we reserve the right not to reschedule.
Cancellations for Path to Grace require 48 hours written notice. The full value of Services used will be calculated and we will notify you if you are entitled to a refund or required to pay an additional final amount. If you choose not to use the remainder of your Service, you may gift it to a friend once approved by Graceful Women.
Payment Plans
Our payment plans are managed by PayPal. You will be required to have a PayPal account to use this option. By selecting the payment plan option you agree to honouring the scheduled payment agreement. Recurring payments are collected on the same day of the month commencing on the day you sign up. Please ensure you have the available funds in your account each month. If you do not, PayPal reattempts a recurring payment three days after the recurring payment failed. If this first reattempt fails, PayPal waits 5 days to reattempt a second time. If the second reattempt fails, PayPal cancels the subscription. An administration fee may be applied to restore a cancelled subscription. We understand that circumstances change. Please connect with us as soon as possible if you are experiencing financial difficulty to make alternative arrangements for your payment plan.
Our Website
We update our website regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Jurisdiction
The Australian courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site, our Terms or any Contract. We reserve the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

Graceful Women is committed to providing you with the best possible customer service experience. We are bound by the Privacy Act 1988, which sets out a number of principles concerning the privacy of individuals.
Collection, sharing and use of your personal information
When joining our newsletter, purchasing products or services you will be required to give your name, and contact details which may include a postal address. Graceful Women does not and never will share your personal information and we endeavour always to protect your personal information to the best of our ability.
For each visitor to reach our website, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalised content to you while you are at this site.
Changes to this Privacy Policy
Graceful Women reserves the right to make amendments to this Privacy Policy at any time. If you have objections to the Privacy Policy, you should not access or use our site.
Photographs and Videos
During delivery of our Services we may photograph individual or group activities. We will request your permission to use these images publicly by agreement to the following statement:
“I grant Graceful Women, its representatives and employees the right to take photographs of me and my property in connection with the above-identified subject. I authorise Graceful Women, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that Graceful Women may use such photographs and or video material of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.”
